Our Commitment to Your Privacy

At McClendon Benefits Solutions (“MBS,” “we,” “our,” or “us”), protecting the privacy and confidentiality of our clients, prospective clients, business partners, and website visitors is an important responsibility.

Because we help individuals, families, and employers in Greater Houston and surrounding Texas communities with insurance and employee benefits, we recognize that they and their employees may entrust us with confidential personal, financial, insurance, and health-related information.

This Privacy Policy explains how we collect, use, disclose, maintain, and protect personal information when you visit our website, contact us, request insurance assistance, request home or auto insurance quotes, ask about LegalShield memberships, participate in employee benefits services, schedule an appointment, or obtain notary or loan signing services.

We seek to handle personal information responsibly and in accordance with applicable federal and Texas laws, including applicable provisions of the Texas Insurance Code, Texas insurance privacy regulations, and other privacy and data security requirements.

1. Business Information and Scope

McClendon Benefits Solutions (MBS) is the business name under which Cameron McClendon, a licensed Texas insurance agent, provides insurance and employee benefits services. MBS is not an insurance carrier. Insurance products are offered through Cameron McClendon and the insurance carriers and agencies he is authorized to represent.

Texas Insurance Agent License: 3253199
National Producer Number (NPN): 21370569

MBS provides assistance involving employee benefits, individual and family health insurance, dental and vision coverage, supplemental insurance, life insurance, and other insurance products available through our authorized relationships.

We also provide traditional and remote online notary services, subject to applicable Texas law.

For home and auto insurance, MBS does not directly sell, bind, underwrite, or service policies; at your request, we can connect you with an appropriately licensed insurance professional in our office. Cameron McClendon is also an independent LegalShield associate. LegalShield memberships are legal service plans, not insurance, and MBS is not a law firm.

This Privacy Policy applies to information we receive through our website, insurance-related consultations, contact forms, scheduling tools, business communications, telephone calls, email, permitted text communications, and in-person interactions.

Additional privacy notices may apply to specific insurance products, carriers, government marketplaces, and third-party service providers. Independent insurers and service providers apply their own privacy policies to the information they receive.

2. Categories of Information We Collect

Depending on the services requested, we may collect the following categories of information:

Personal and Contact Information

  • First and last name
  • Mailing address and ZIP code
  • Email address and telephone number
  • Date of birth
  • Preferred method of communication

Insurance and Coverage Information

  • Current insurance coverage and policy details
  • Coverage preferences and eligibility information
  • Household and dependent information
  • Application, enrollment, and renewal information
  • Relevant employment and benefits information
  • Insurance-related financial or underwriting information

The information above is ordinary inquiry and coverage information. Our website forms ask only for basic details, such as your name, contact information, ZIP code, and the coverage or services you are interested in.

Sensitive Personal Information

Sensitive information is handled separately from ordinary inquiry information. It includes Social Security numbers, medical histories, health conditions and prescriptions, bank account and payment information, identification documents, beneficiary details, and employee census files.

When reasonably necessary to assist with insurance applications, underwriting, enrollment, or related services, we may receive Social Security numbers, health-related information, financial information, or other sensitive information required by a carrier or authorized program.

We seek to collect sensitive information only when reasonably necessary for an authorized business purpose or as otherwise permitted or required by law.

Business and Employee Benefits Information

When assisting employers with employee benefits, we may receive:

  • Business name and contact information
  • Employee counts and coverage eligibility information
  • Employee and dependent names
  • Dates of birth, ZIP codes, and other information necessary for quoting or enrollment
  • Coverage elections and enrollment information
  • Other information reasonably required by an authorized carrier or benefits administrator

We encourage employers to provide only information necessary for the requested insurance transaction and to use appropriately secure transmission methods. Employee census files and enrollment data should be provided through a carrier’s or benefits administrator’s secure portal, or another secure method arranged with us, rather than through website forms.

Website and Technical Information

Our website infrastructure and service providers may process technical information, including IP addresses, browser information, device information, security signals, and information about requested website pages.

When you submit a website form, our website briefly uses your IP address to limit repeated submissions and passes it to Cloudflare Turnstile to help confirm the submission is not automated. Your IP address is not included in the request we receive and is not saved with it.

3. Sources of Information

We may obtain information directly from you or, when permitted, from:

  • Employers and authorized benefits administrators
  • Insurance carriers and their authorized representatives
  • Insurance agencies, general agencies, and marketing organizations involved in servicing coverage

We may verify or supplement information when reasonably necessary to perform services or comply with applicable law.

  2. Evaluate insurance and employee benefits needs.
  3. Obtain insurance quotations and compare available coverage.
  4. Assist with insurance applications, enrollment, and renewals.
  5. Communicate with insurance carriers and authorized service partners.
  6. When you request home or auto insurance quotes and acknowledge sharing on the request form, connect you with an appropriately licensed insurance professional in our office.
  7. Answer questions about LegalShield memberships and direct you to the official LegalShield associate website for enrollment.
  8. Assist employers with employee benefits implementation and administration.
  9. Schedule consultations, meetings, and policy reviews.
  10. Provide notary and loan signing services.
  11. Maintain required business, insurance, and notarial records.
  12. Prevent fraud and spam, protect information, and maintain website security and functionality.

  14. Provide relevant information about our services, subject to applicable communication preferences and consent requirements.

We do not use personal information for purposes that are prohibited by applicable law.

5. Insurance Consumer Privacy and Confidentiality

Information obtained in connection with insurance services may constitute nonpublic personal financial information, health information, or other protected insurance consumer information under applicable laws and regulations.

MBS seeks to limit access to such information to persons and organizations with a legitimate business need or legal authorization.

This may include insurance carriers, authorized intermediaries, enrollment service providers, and other parties necessary to quote, issue, administer, or service requested coverage.

We do not sell insurance customer information to unrelated third parties for their independent marketing purposes.

We do not disclose nonpublic personal information for unrelated purposes except as authorized by the individual or as otherwise permitted or required by applicable law.

Where applicable law requires a separate insurance consumer privacy notice, authorization, disclosure, or opt-out opportunity, those requirements will be addressed separately.

Insurance carriers and government-sponsored programs may maintain their own privacy notices governing the information they collect and process.

Back to contents

6. Employee Benefits and Employer-Provided Information

MBS provides employee benefits assistance to businesses seeking coverage for eligible employees and dependents.

Employers may provide census information, eligibility records, and other information necessary to request group insurance quotations or administer coverage.

We seek to use such information only for legitimate benefits-related activities, including eligibility evaluation, quoting, enrollment, renewal, and authorized servicing.

We recognize the importance of protecting employee and dependent information and seek to restrict access based on legitimate business needs.

We do not provide employers with individual medical histories, diagnoses, or other confidential medical information merely because they sponsor an employee benefits plan.

Information may be shared with employers, plan sponsors, carriers, or administrators when legally authorized and necessary for eligibility, enrollment, plan administration, or another permitted purpose.

Depending on the transaction and MBS’s specific role, additional obligations under HIPAA, ERISA, and applicable insurance privacy laws may apply. Any required agreements, notices, or authorizations will be addressed as appropriate.

HIPAA does not apply to every MBS activity. For example, it generally does not govern ordinary website inquiries or notary services. Where MBS performs services for a group health plan in a role that HIPAA covers, such as a business associate, we will follow the requirements that apply to that role.

7. Website Contact Forms and Communications

When you submit information through our website contact form, we collect the details you voluntarily provide, such as your name, email address, optional telephone number, service interest, and message.

Our currently configured website uses Cloudflare for hosting and security, Cloudflare Turnstile for automated-submission protection on the contact form, the insurance inquiry forms, and the loan signing quote form, Resend for website form email delivery, and Google Workspace for business email.

Contact-form submissions are transmitted to our business email inbox. The website’s contact-form implementation is configured not to maintain a separate database of submitted messages.

However, message contents, technical metadata, and delivery records may be processed or retained by the email and infrastructure providers involved.

Loan signing quote requests submitted through our Loan Signing Services page are sent to our business email and stored in a secured Cloudflare D1 database that only Cameron McClendon can access, so we can prepare and track your quote. This form does not ask for Social Security numbers, identification documents, loan documents, account numbers, or street addresses. Quote request records are deleted when no longer needed, generally within 12 months after the request is completed or declined.

Insurance inquiry forms on our insurance pages and the Business Benefits page collect your name, email address, telephone number, ZIP code, preferred contact method, the coverage or benefits you are interested in, and optional comments. Business requests also ask for the business name and number of employees. Home and auto quote requests also ask whether you are interested in home, auto, or both, and record your acknowledgment that your request may be shared as described in the next section. These requests are sent to our business email inbox and, like contact-form messages, are not stored in a separate website database. These forms do not ask for Social Security numbers, health histories, banking information, beneficiary details, or full insurance applications. The consent box on these forms covers contact about that request only and does not sign you up for marketing communications.

Please do not submit Social Security numbers, medical histories, banking credentials, payment card numbers, or other highly sensitive information through general website contact forms or appointment notes.

When sensitive information is required for an insurance application, enrollment, or related service, we may collect it by telephone, email, or text message. Ordinary email and text messages are not completely secure, so you may instead provide sensitive information by telephone, or through an appropriate secure carrier application, authorized enrollment platform, or another suitably protected communication process when that option is available. For documents and detailed application or enrollment information, we recommend using the carrier’s secure application or enrollment portal whenever one is offered.

8. Home and Auto Insurance Quote Requests

MBS does not directly sell, bind, underwrite, or service home and auto insurance policies. When you submit a home or auto quote request on our Home & Auto pages, the request is emailed to Cameron McClendon. If you check the required acknowledgment on that form, MBS may share your request, including your name, contact details, ZIP code, preferred contact method, home and/or auto interest, and comments, with an appropriately licensed insurance professional in our office so that they can follow up with you about quotes and coverage options.

We do not automatically send home and auto requests to unnamed third parties, and we do not sell them. The form cannot be submitted without the acknowledgment. If you would prefer that your request not be shared, please do not submit the form and contact us instead.

Quotes, coverage recommendations, policy placement, and servicing are handled by that licensed professional and, where applicable, the insurance companies they work with, which apply their own privacy notices to the information they receive. The form does not ask for driver’s license numbers, Social Security numbers, vehicle identification numbers, or mortgage documents; please provide those only directly to the licensed professional or insurer when required for a quote.

9. LegalShield Memberships

Our Legal Protection pages describe LegalShield memberships. MBS does not take LegalShield enrollments or payments on this website. When you select a LegalShield enrollment link, you leave the MBS website and go to Cameron McClendon’s LegalShield associate website,cameronmcclendon.legalshieldassociate.com, which is operated by or for LegalShield (Pre-Paid Legal Services, Inc.).

Information you submit on the LegalShield associate website or to LegalShield, including enrollment and payment details, is collected and handled under LegalShield’s own terms and privacy practices. This policy does not describe how LegalShield or its provider law firms handle that information. The MBS website does not receive information from LegalShield or from the LegalShield associate website.

If you send us a LegalShield question through our contact form, email, or phone, we use it to respond to you. Please do not send us confidential details about a legal matter; those should go to the provider law firm.

10. Information Sharing and Third-Party Disclosures

We may disclose information to third parties when reasonably necessary to deliver requested services, comply with applicable law, or carry out other authorized purposes.

Categories of recipients may include:

  • Insurance Carriers and Authorized Insurance Partners: To obtain quotes, submit applications, process enrollment, maintain coverage, and assist with servicing.
  • Licensed Insurance Professionals in Our Office: If you request home or auto insurance quotes and give the acknowledgment on the request form, we share your request with an appropriately licensed insurance professional in our office so that they can follow up with you about quotes.
  • Employers and Benefits Administrators: For authorized eligibility, enrollment, and benefits administration activities, subject to applicable confidentiality restrictions.
  • Technology and Operational Service Providers: To support website hosting, email communications, telephone answering, scheduling, security, consultations, and other business operations.
  • Notary and Identity Verification Providers: When needed to complete notarial transactions, verify identity, or preserve legally required notarial records.
  • Government and Regulatory Authorities: Where disclosure is required or authorized by applicable law, legal process, or regulatory obligations.
  • Professional Advisers: Where reasonably necessary for authorized accounting, auditing, legal, compliance, or related professional services.

We may also disclose information in connection with a legitimate business reorganization or transfer when legally permitted and subject to applicable confidentiality and regulatory requirements.

We do not sell customer lists or disclose personal information for unrelated third-party advertising.

Insurance carriers and service providers that receive information apply their own privacy policies and practices to it.

11. Cookies, Website Services, and Tracking

Our current website configuration does not intentionally deploy first-party advertising trackers, analytics services, or social media advertising pixels.

The MBS website’s own code does not set cookies and does not use your browser’s local or session storage to track you. Because we do not use advertising or analytics cookies, the website does not currently show a cookie consent banner.

However, the website relies on external infrastructure and services that may process technical information or use cookies or similar technologies.

These may include:

  • Cloudflare (including Cloudflare Workers) for hosting, network security, and abuse prevention, and a Cloudflare D1 database for loan signing quote requests.
  • Cloudflare Turnstile for bot and spam protection on our forms. Turnstile loads only on pages with a form.
  • Google Fonts for website typography. Your browser requests the font files from Google’s servers, which receive your IP address and browser information.
  • Calendly for appointment scheduling.
  • Resend and Google Workspace for email processing and communications.

Calendly’s scheduling tool loads only when you select a booking button. Calendly may collect information and use cookies when visitors interact with its scheduling services.

Third-party providers may operate under their own privacy notices and retention practices.

You may manage certain cookie preferences through your browser settings, although disabling particular technologies may affect website features.

If MBS introduces analytics, advertising pixels, additional tracking technologies, or material changes to website data processing, we will review and update this notice and implement any additional legally required disclosures or choices.

12. Appointment Scheduling and Video Consultations

When you schedule a consultation, certain information, such as your name, contact details, appointment preferences, and information voluntarily provided in scheduling notes, may be processed through Calendly or another scheduling provider.

Appointments may take place by telephone, in person, Google Meet, Zoom, or another authorized communication platform.

Information processed directly by those providers may also be governed by their respective privacy policies.

Please avoid including confidential insurance, medical, financial, or identification information in general scheduling notes.

13. Email, Telephone, Text Messaging, and Marketing

MBS may communicate with individuals and business representatives regarding requested services, appointments, applications, coverage questions, policy reviews, and other legitimate business matters.

We may also provide information regarding relevant insurance products or services when permitted by applicable law.

Promotional email communications will include an appropriate opportunity to unsubscribe where legally required.

Marketing text messages or automated communications will only be sent where appropriate consent and applicable legal requirements have been satisfied.

Providing a telephone number through a general contact form does not, by itself, constitute consent to receive automated marketing calls or text messages.

If you choose text message as your preferred contact method on a website form, we may text you about that request. MBS does not currently operate a marketing text-message program, and you may ask us to stop texting you at any time.

If MBS establishes a subscription-based SMS program, additional disclosures regarding consent, message frequency, opt-out instructions, and applicable carrier charges will be provided.

Mobile telephone numbers and text-messaging consent information will not be sold or shared with unrelated third parties for their independent marketing purposes.

Information may be provided to communication service providers as needed to transmit authorized messages and operate the messaging service.

You may request that MBS discontinue nonessential promotional communications by contacting us.

Certain transactional, servicing, legally required, or otherwise permitted communications may continue where appropriate.

14. AI Receptionist and Telephone Communications

McClendon Benefits Solutions uses Smith.ai, Inc. (“Smith.ai”), a third-party AI receptionist service, to assist with incoming business calls, general inquiries, message collection, and customer communications.

When we are unable to answer a call to our business line, the call may be answered by an automated AI receptionist, which takes a message for Cameron McClendon. The AI receptionist does not currently transfer calls to a live person; Cameron follows up on the message.

In providing these services, Smith.ai may process information such as your name, telephone number, general inquiry details, appointment preferences, and other information you voluntarily provide during a call.

Calls handled by our AI receptionist may be recorded, transcribed, and summarized. The greeting tells callers at the beginning of the call that they are on a recorded line. Summaries, messages, recordings, and transcripts may be made available to McClendon Benefits Solutions through Smith.ai’s online dashboard and through email notifications sent to our business email. These notifications may include your name, telephone number, and the details you shared. We use this information to respond to your inquiry, return missed calls, coordinate appointments, maintain appropriate business records, and improve customer service.

If you ask about an appointment during a call, the AI receptionist may take your request so that MBS can follow up with you to arrange a time. Appointments scheduled online through our booking links are handled as described under Appointment Scheduling and Video Consultations.

After your call, the AI receptionist may send a follow-up text message about your call to the number you called from. That message is a response to your call, not a marketing subscription, and calling MBS does not, by itself, sign you up for marketing calls or text messages. You may ask us to stop texting you at any time.

Information is processed by Smith.ai in connection with providing communications services to our business, following our instructions and subject to applicable privacy requirements and contractual arrangements. Smith.ai’s Terms of Service state that it keeps the information it collects for its subscribers confidential, shares it only with Smith.ai staff who need it to provide the services, and will not sell it. Those terms also permit Smith.ai to use the information to provide and improve its services. Smith.ai’s handling of information is described in its Terms of Service (opens in a new tab) and Privacy Policy (opens in a new tab). MBS does not sell call information.

Call recordings, transcripts, and related records may be subject to different retention practices depending on the service provider, applicable settings, downloaded copies, and our own lawful recordkeeping needs. Smith.ai’s published materials state that recordings and transcripts are kept in its online dashboard for 90 days. Summaries and messages sent to our business email, and any recordings or transcripts we download, may be kept longer, as described under Data Retention and Disposal.

For privacy questions about a call, or to make a request about call information, please contact us using the details under Privacy Requests and Consumer Choices. Where appropriate, we can ask Smith.ai to delete information it holds for us, subject to its procedures and our legal and recordkeeping obligations.

If you prefer not to speak with an AI receptionist or be recorded, you may end the call and contact us by email or through our contact form instead.

Please do not share Social Security numbers, complete medical histories, credit card or bank account information, driver’s license or other identification numbers, confidential legal details, or loan documents with our AI receptionist. If that information is needed, Cameron McClendon will arrange an appropriate secure way to provide it.

15. Client Reviews and Testimonials

MBS may invite clients to provide feedback, reviews, or testimonials about their experience. MBS does not currently publish client testimonials on this website.

Submitting feedback does not automatically authorize its public publication.

Before publishing a testimonial that identifies an individual, we will seek appropriate permission for the intended use of their name, statement, photograph, or other identifying information.

We will not knowingly disclose a client’s confidential medical, financial, or insurance application details in a public testimonial without appropriate authorization.

Reviews submitted through third-party platforms, such as Google, may be governed by the privacy policies and publication settings of those services.

Clients may contact MBS regarding concerns about testimonials published directly by MBS.

16. Notary Public and Remote Online Notarization

MBS also provides notary services through Cameron McClendon in his capacity as a commissioned Texas Notary Public.

Texas law requires notaries to maintain records of certain notarial acts.

These records may contain names, addresses, information concerning identification documents, transaction details, and other legally required information.

Certain notarial records are public records and may be available for inspection or copying in accordance with Texas law.

For remote online notarization, we currently use the Proof platform, with BlueNotary as a backup platform. Identity verification procedures may involve identification documents and other identity-verification information.

Texas law requires audio and video recordings and specified electronic records of online notarial acts.

Online notarization records and required backups must generally be maintained for at least five years after the notarization.

Traditional notarial records are maintained for the applicable period prescribed by Texas law.

Because of legal recordkeeping and public-access requirements, we may be unable to delete or restrict access to certain required notary records.

Third-party online notarization platforms may maintain additional privacy and security practices described in their own notices.

17. Information Security

We seek to maintain reasonable administrative, technical, and physical safeguards designed to reduce the risk of unauthorized access, misuse, alteration, disclosure, or loss of personal information.

Measures may include access controls, account authentication, encrypted website connections, appropriate use of reputable service providers, and procedures for handling confidential information.

Access to sensitive information should be limited to authorized persons with a legitimate need to perform applicable services.

We encourage the use of secure insurance carrier and enrollment systems for transmitting sensitive application and benefits information.

Although we take reasonable measures to protect information, no electronic system, transmission method, or storage environment can be guaranteed completely secure.

Where a security incident triggers applicable notification obligations, we will respond in accordance with relevant law.

Back to contents

18. Data Retention and Disposal

We retain information for the period reasonably necessary to perform requested services, maintain legitimate business records, fulfill contractual obligations, and comply with applicable legal or regulatory requirements.

Retention periods may differ depending on the type of information and the services provided.

Insurance records may be retained as required by applicable insurance regulations, carrier agreements, or other governing requirements.

Website inquiries and business correspondence may be retained as necessary to respond to inquiries, document client relationships, and maintain appropriate business records.

Notarial records will be retained for the periods required by Texas law.

Telephone call summaries, messages, recordings, and transcripts are handled as described under AI Receptionist and Telephone Communications.

Third-party providers may separately retain information under their own retention practices and legal obligations.

When information is no longer needed and no applicable obligation requires continued retention, we seek to securely delete, dispose of, or otherwise appropriately manage the information.

19. Privacy Requests and Consumer Choices

Depending on the circumstances and applicable law, individuals may have rights to request access to information, correction of inaccurate information, deletion of certain information, or information about relevant disclosure practices.

Individuals may also have rights relating to certain nonessential communications or disclosures.

Which privacy laws apply depends on the information and the service involved. Insurance information is generally governed by federal and Texas insurance privacy laws, such as the Gramm-Leach-Bliley Act and the Texas Insurance Code and related Texas Department of Insurance rules, and certain health information may be governed by HIPAA. General consumer privacy laws, such as the Texas Data Privacy and Security Act, exempt certain businesses and certain categories of information, so not every right under those laws will apply to every request. Whether or not a particular law applies, you may contact us with any privacy request, and we do not sell personal information, including sensitive personal information.

To submit a privacy-related request, contact:

Please identify the nature of your request and provide sufficient contact information for us to respond.

We may need to reasonably verify your identity or authority before disclosing, modifying, or deleting personal information.

We will review and respond to requests in accordance with applicable law.

Some requests may be restricted by insurance recordkeeping requirements, legal obligations, ongoing transactions, notary public record requirements, or other applicable exceptions.

Information maintained independently by an insurance carrier or external service provider may need to be requested directly from that organization.

20. Children’s Privacy

Our website is intended for adults and individuals seeking legitimate insurance, employee benefits, or notarial services.

It is not directed toward children under 13 years of age, and we do not knowingly solicit personal information directly from children under 13 through general website forms.

Information concerning children or dependents may be collected from an authorized parent, legal guardian, employer, or other appropriately authorized source when necessary for legitimate insurance-related purposes.

Such information will be handled subject to applicable privacy and insurance requirements.

21. External Websites and Third-Party Services

Our website may provide links to insurance carriers, scheduling platforms, government marketplaces, social media services, notary platforms, the LegalShield associate website, and other third-party websites.

These organizations maintain their own privacy notices and security practices.

MBS does not control the independent collection, use, retention, or disclosure practices of third-party websites and encourages users to review the applicable privacy notices before submitting personal information.

22. Changes to This Privacy Policy

We may update this Privacy Policy to reflect changes in our services, website operations, information handling practices, or applicable legal requirements.
